Abstract Despite more than half a century of reform efforts, access to civil justice is still understood be in state crisis. Part the reason for this because there no consensus among legal community on meaning context. This paper seeks provide much-needed theoretical underpinning access-to-civil-justice movement. It advances ‘justice as fairness,’ articulated by American philosopher John Rawls, conjunction with Lesley Jacobs’ model equal opportunities, suitable theory which frame I explain why framework appropriate pluralistic democracies like Canada and how it can used define measures justice. exercise thus not simply discussion, but rather intended practical assess current proposed policy initiatives.
